| This Week's Q&A...Establishment of Easements? |
Q: If an individual or utility company approached a resident inquiring about establishing an easement across his or her property, how would that be accomplished and does it need to be reviewed and approved by the City?
A: An easement is established by: 1) a deed and exhibit; or 2) an easement dedication plat. It is dependent upon the type of easement being requested, as to which instrument is utilized to create it. If it is for utility or maintenance purposes, such as a retaining wall situated on more than one (1) property, typically a deed, with associated exhibit showing a graphic depiction of the area, would suffice. If the easement is designated for vehicular use [ingress/egress], an easement dedication plat would be required, given the associated fifty (50) structure setback distance, relative to the edge of easement, would further encumber the property. Any easement created within the City of Wildwood, regardless if it is upon public or private property, is governed under Chapter 420: Subdivision and Development Regulations and requires City review and approval, prior to recording with St. Louis County. If such situation arises with you, please contact the Department of Planning's Subdivision Planner, Terri Gaston, at City Hall, 636.458.0440, ext. 118 for questions relating to the processing of an easement. |
