BOARD OF ADJUSTMENT OF THE CITY OF WILDWOOD, MISSOURI

The Board of Adjustment of the City of Wildwood will hold a public hearing at 7:00 p.m. on Thursday, April 18, 2019 in the City Hall Council Chambers, 16860 Main Street, Wildwood, Missouri 63040. The purpose of this hearing is to consider requests for variances to certain Zoning Ordinance regulations or interpretations of their intent made by the Director of Planning relating to the individual properties identified below. Please review the individual notice of publication pertaining to your petition of interest for information relating to it. To report any inaccuracies in the text or seek further information about these requests, please contact the Department of Planning and Parks at (636) 458-0440, prior to the hearing date. At this hearing, the following requests will be considered by the Board of Adjustment for action:

I.

B.A. 3-19 Patricia & Robert ‘Dean’ Bordeaux, 25 Edwin Avenue, Glendale, Missouri 63122 c/o John Odom, PO Box 410394, St. Louis, Missouri 63141

request an exception to the exception to the Floodplain District Regulations of the City of Wildwood for the purpose of constructing a single-family dwelling, which would be situated upon the property located at 816 Forby Road (Locator Number 28W630212; Bopp Estates Resubdivision – Tract C).  If granted, this variance would thereby authorize a floodplain setback distance of twenty-five (25) feet, in lieu of the fifty (50) foot standard, as well as a Base Floodplain Elevation of 0.5 feet, in lieu of the two (2) foot standard.  This request is contrary to the requirements of Chapter 415.070 ‘FP’ Floodplain District Regulations and Chapter 415.090 ‘NU’ Non-Urban Residence District of the City of Wildwood Zoning Ordinance; Chapter 405.050 Provisions for Flood Hazard Reduction; and Chapter 425.050 Standards – Safety Precaution of the City of Wildwood Grading Code. request an exception to the Minimum Yard Requirements (general) for the purpose of constructing an inground swimming pool, with concrete decking, upon property located at 2470 August Grove Court (Locator Number 23V330518; The Villages at Bright Leaf – Plat 1; Lot 16-A).  If granted, this variance would thereby authorize a rear-yard setback distance of seven (7) feet in lieu of the fifteen (15) foot standard, which requires the Board of Adjustment’s consideration.  This request is contrary to the requirements of Chapter 415.140 R-3 10,000 square-foot Residence District Regulations of the City of Wildwood’s Zoning Ordinance and the Planned Residential Development Overlay District (PRD) Ordinance #2145, approved by the City Council in January 2016.  (Ward Five)

request an exception to the Minimum Yard Requirements (general) for the purpose of installing a replacement wastewater treatment system for an existing single-family dwelling (circa 1956) upon the property located at 353 Eatherton Road (Locator Number 19W510017; a two (2) acre tract of land in U.S. Survey 163, T45N, R3E). If granted, this variance would thereby authorize a side-yard setback distance for the drainfield at twenty (20) feet in lieu of the thirty (30) foot standard and at a distance of sixty-five (65) feet in lieu of the one hundred (100) foot standard from the potable water source [i.e. well], as well as the aeration tank at a distance of seventy-three (73) feet in lieu of the one hundred (100) foot standard from the same.  This request is contrary to the requirements of Chapter 415.090 NU Non-Urban Residence District Regulations of the City of Wildwood’s Zoning Ordinance.  (Ward One)

B.A. 6-19 Ossenfort Valley Homeowners Association c/o Charles ‘Chuck’ Edmundson, Trustee, 2405 Redbud Valley Court, Wildwood, Missouri 63038

requests an exception to the Minimum Yard Requirements (general) for the purpose of replacing permanent signage for the Ossenfort Valley Subdivision, which would be located upon private property, but within an easement for said purpose, at 19303 Ossenfort Court (Locator Number 22Y510161; Ossenfort Subdivision, Lot 35), which would thereby authorize the allowable Subdivision Information Sign, a monument-style type, to be placed within the fifty (50) front-yard setback area at distances of nine (9) feet from Ossenfort Court and twenty-four (24) feet from Ossenfort Road.  This request is contrary to the requirements set forth in Chapter 415.090 NU Non-Urban Residence District Regulations and Chapter 415.410 Sign Regulations for “FP”, “PS”, “NU” and all “R” Districts of the City of Wildwood’s Zoning Ordinance. V.

B.A. 7-19 Covert-Corsair Homes, Inc., Profit Sharing Plan, P.O. Box 280, Wildwood, Missouri 63040 c/o Mary Kay Corsair, 17617 Melrose Road, Wildwood, Missouri 63038

requests an exception to the Failure to Commence Construction (General) and the General Development Conditions (Particular) for the purpose of extending the deadline for the commencement of substantial construction at 16815 Manchester Road (Locator Number 24V630286), which would thereby authorize the deadline for substantial construction to begin on this project no later than July 17, 2020, in lieu of the previous deadline of January 17, 2019. This request is contrary to the requirements of Chapter 415.190 C-8 Planned Commercial District Regulations of the City of Wildwood Zoning Ordinance and C-8 Planned Commercial District Ordinance #1953, which was approved by the City of Wildwood in 2013, and governs this property. The City Council did not extend this timeline, when presented this request on February 25, 2019. (Ward Eight)

B.A. 8-19 Patrick & JoAnn Muenks, 17824 Mueller Road, Wildwood, Missouri 63038

request an exception to the Minimum Yard Requirements (general) for the purpose of constructing an accessory structure [i.e. 30’x36’ detached garage, totaling 1,080 square feet] upon property that is located at 17824 Mueller Road (Locator Number 23W130108; Mueller Crossing Subdivision, Lot 3), thereby authorizing a front-yard setback distance of twenty-five (25) feet in lieu of the fifty (50) foot standard, which requires the Board of Adjustment’s consideration.  This request is contrary to the requirements of Chapter 415.090 NU Non-Urban Residence District Regulations of the City of Wildwood’s Zoning Ordinance.  (Ward One)
VII.

B.A. 9-19 For This Purpose Recycling c/o Dr. Chuck & Allison Hoskins, 4833 Amy Clark Road, Hillsboro, Missouri 63050

request an exception to the Miscellaneous Regulations for the purpose of retaining a temporary accessory structure [i.e. 26.27 square-foot clothing donation bin] upon property that is located at 16580 Manchester Road (Locator Number 23U120480; Schnuck’s Wildwood Crossing - A Section of the Harbors at Lake Chesterfield).  If granted, this variance would thereby authorize this accessory structure to remain upon the property for an undetermined extent of time, although not interpreted by the Co-Interim City Administrator/Director of Planning as temporary in nature, per code provisions. The request is contrary to Chapter 415.380 (M.) Miscellaneous Regulations of the City of Wildwood Zoning Ordinance and the governing, site-specific MXD Mixed Use Development District Ordinance #17,566, which was approved by St. Louis County in 1985 and, thereafter, amended a number of times by the previous jurisdiction and the City of Wildwood.  (Ward Seven)
